Changes in the law: written statement of terms

From 6 April 2020 all employers must provide to their employees and workers a written statement of terms on or before the first day of employment.  A statement is currently required to be given to employees only and only before the two-month anniversary of the start of employment.

More information than is currently required must be provided.  The additional information includes:

  • the days of the week the worker is required to work (as well as normal working hours), whether the working hours may be variable and how any variation will be determined;
  • any paid leave to which the worker is entitled (eg family friendly leave);
  • details of all remuneration and benefits (including non-contractual benefits);
  • any probationary period (including conditions and duration); and
  • any training entitlement provided by the employer, including whether any training is mandatory and/or must be paid for by the worker.

It is a good time to review template contracts and statement of terms.  Employers should ensure that legal compliance is achieved, not just with these legal developments, but to cover recent legal changes that employers may not have addressed eg recent data protection law changes .
