When companies:
- buy or sell a business, or part of a business, or
- win or lose a contract to supply services, or
- outsource or insource a business activity,
they will need to be guided on the effects of TUPE.
Employees will automatically transfer from one employer to another when TUPE applies. Their employment rights are protected and any attempt to change their terms or dismiss them lawfully is very difficult. They also have a right, via their representatives, to be informed and consulted with before the transfer.
The employer that is either selling or has lost a service contract has a legal obligation to provide information to the acquiring employer.
The liabilities associated with TUPE breaches can be significant, but we have the knowledge and experience to guide you through the process and explain all you need to know. We have advised on all types of TUPE transfers for outgoing and acquiring employers.
